“PEACE OF MIND” PROMOTION (New Zealand)
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. There are two (2) components to this promotion, namely the “End User Component” and “Trade Component”. Entry into the End User Component is only open to New Zealand residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and resellers and agencies associated with this promotion are ineligible to enter the End User Component. Entry into the Trade Component is only open to participating New Zealand retailers and resellers.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Promotion commences 12:01am NZ local time on 1/02/10 and closes 11:59pm NZ local time on 30/06/10 (“Promotional Period”).
5. To receive an entry in the End User Component, an individual must, during the Promotional Period:
(a) purchase a new, renewal or upgrade version of Trend Micro Internet Security Pro 2010, Trend Micro Internet Security 2010, Trend Titanium, Trend Smart Surfing for Mac or Trend Micro Worry Free (“Participating Software”) from any participating Australian retail store, reseller or online via http://shop.trendmicro.co.nz; and then install and register their Participating Software; or
(b) purchase any Trend Micro Premium Services product, including but not limited to, Premium Installation Service, Premium Services Plan, Security Health Check Service, or Virus Removal Service; online via http://shop.trendmicro.co.nz.
6. The entrant will receive an entry in the relevant monthly draw according when they undertake the steps as outlined above. For the entrant’s entry to be considered valid for the purpose of the relevant monthly draw, the entrant must, according to the Promoter’s records, still be subscribed to the product that they purchased which originally entitled them to that entry, at the time of that particular draw.
7. Incomplete, indecipherable or illegible entries will be deemed invalid.
8. Multiple entries permitted, subject to the following: only one (1) entry permitted per specified purchase requirement.
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
10. There will be two draws for this promotion. All entries received during February and March will be entered into Draw 1, and all entries received during April, May and June will be entered into Draw 2. The draws will take place at Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street, St Leonards NSW 2065 at 10:00am Sydney local time on 7/04/10 (Draw 1) and 7/07/10 (Draw 2). Entries received for Draw 1 will not be entered into Draw 2. Winners will be notified by email. The Promoter’s decision is final and no correspondence will be entered into
11. The first valid entry drawn in each monthly draw in the End User Component of this promotion will each win $15,000. In addition, under the Trade Component, the participating New Zealand retailers or resellers who sold the Participating Software to each of the winners in the End User Component, based on the Promoter’s records, will each win $10,000. In the event that a winner of an End User Component prize purchased the Participating Software or Trend Micro Premium Services directly from the Promoter, then the Trade Component prize will not be awarded. Prizes will be awarded in the form of a cheque.
12. Total prize pool value is up to $50,000. Prizes are not transferable or exchangeable.
13. A draw for any unclaimed prizes may take place on 20/10/10 at the same time and place as the original draw.
14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
17. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
